DO NOT TRACK

DATA RETENTION
We retain your personal data for as long as it is reasonably necessary to provide our Services; to maintain and expand our relationship and provide you with our Services and offerings; to comply with our legal and contractual obligations; or to protect ourselves from any potential disputes (e.g. as required by laws applicable to log-keeping, records and bookkeeping, and in order to have proof and evidence concerning our relationship, should any legal issues arise following your discontinuance of use), all in accordance with applicable laws and regulations, and where applicable, also in accordance with our Distributor’s relationship with you.
COMMUNICATIONS
We engage in service and promotional communications, through e-mail, mail, phone, SMS and notifications.
Service Communications: we may contact you with important information regarding our Services. For example, we may send you notifications (through any of the means available to us) of changes or updates to our Services, billing issues, payment issues, login attempts or password reset instructions, or regarding customer service relating to our Services, etc. Our Distributors may also send their Users on the same Distributor account notifications, messages and other updates regarding your use of our Services.
Notifications and Promotional Communications: we and our authorized partners (e.g., event or webinar co-sponsors) may also notify you about new features, additional offerings, events, webinars, special opportunities or any other information we think you will find valuable. We may provide such notices through any of the contact means available to us (e.g., SMS, phone, mail, mobile or e-mail), through the Services, or through our marketing campaigns on any other sites or platforms.
You can typically control your communications and notifications settings from any of your Netafim profile settings, or otherwise by following the instructions included in the communications sent to you. If you do not wish to receive promotional communications, you may also notify Netafim by sending an e-mail to: data.privacy@netafim.com.
INFORMATION SECURITY
We recognize the importance of data security for our customers. We treat your data with the utmost care and have put in place appropriate security measures to protect the confidentiality, integrity and availability of your personal information from unlawful or unauthorized processing and accidental loss, destruction or damage. We monitor our network & systems for vulnerabilities and attacks and also carry out regular testing to identify ways to further strengthen our security. Although we take commercially reasonable measures to protect your personal information, we cannot guarantee its security. For this reason, we urge users to take every precaution to protect their personal information whilst using the internet.
CHILDREN’S PRIVACY
The Services are not intended for individuals under the age of eighteen (18) years. If we learn that we have collected or received personal information from individuals under the age of eighteen (18), we will delete the personal information. CHANGES TO THIS PRIVACY POLICY
We may amend this Privacy Policy in our sole discretion at any time. If we do, we will post the changes to this page, and will indicate the date the changes go into effect. If we make changes that materially affect your privacy rights, we will notify you by prominent posting on our Sites and/or via email, and request your consent, if required.
RIGHTS OF CALIFORNIA RESIDENTS
The California Privacy Rights Act (“CPRA”) entitles California residents to certain rights. To the extent the CPRA applies to our processing of your personal information, you are entitled to the following rights:
- Right to Access/Know: You have the right to request what personal information we have collected, used, disclosed, and sold about you, unless doing so proves impossible or would involve disproportionate effort. - Right to Deletion: You have the right to request the deletion of your personal information that we collect or maintain, subject to certain exceptions. - Right to Opt Out of Sale/Sharing: You have the right to opt out of the sale or sharing of your personal information to third parties. Netafim does not have actual knowledge that it sells or shares personal information of minors under the age of sixteen (16) years. - Right to Non-Discrimination: You have the right to not receive discriminatory treatment if and when you exercise your rights to access, delete, opt out, correct, or limit use of sensitive personal information under the CPRA.
- Right to Correct: You have the right to correct inaccurate personal information that we collect or maintain.
- Right to Limit Use of Sensitive Personal Information: You have the right to limit the use of your sensitive personal information when such use goes beyond that which is necessary for providing the services or certain other permissible purposes like fraud, customer service or quality control. Sensitive personal information includes Social Security number, driver’s license number, biometric information, precise geolocation, and racial and ethnic origin. Netafim does not use sensitive personal information collected through our Services in this manner.

For requests submitted via telephone, you must provide us with sufficient information that allows us to reasonably verify you are the person about whom we collected the personal information and describe your request with sufficient detail to allow us to properly evaluate and respond to it. In doing so, we will take steps to verify your request by matching information provided by you with the information we have in our records. If we are not able to verify your identity for access and deletion requests with the information provided, we may ask you for additional pieces of information.
Only you, or a person that you authorize to act on your behalf may make a request related to your personal information. If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation that you are authorized to act on behalf of that individual.
RIGHTS OF INDIVIDUALS IN THE EUROPEAN UNION
Individuals in the European Union (“EU”) and the United Kingdom (“UK”) are entitled to certain rights under the General Data Protection Regulation (“GDPR”) or the UK Data Protection Act 2018 (“DPA”). If our processing of your personal information is subject to these laws, you are entitled to the following rights:
- Right to rectification: You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
- Right to erasure: You have the right to ask us to erase your personal information in certain circumstances.

- Right to data portability: This only applies to personal information you have given us. You have the right to ask that we transfer the personal information you gave us from one organization to another or give it to you.

Please note that such rights are not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal information that we hold about you. In the event that we cannot accommodate your request, we will inform you of the reasons why, subject to any legal or regulatory restrictions.
Please also note that we may require additional information, including certain personal data, in order to authenticate and process your request. This additional information may be then retained by us for legal purposes (e.g., as proof of the identity of the person submitting the request). We may redact from the data which we will make available to you, any personal data related to others.
Subject to compliance with local law requirements, the recipients of Personal Data described in Section 2 may be located inside or outside your own country, in countries whose laws regarding data protection may not offer an adequate level of protection compared to the laws in your country. For example, not all countries outside the European Economic Area ("EEA") offer the same level of protection as in the EEA.
Netafim will take all necessary measures to ensure that transfers out of your country are adequately protected as required by applicable data protection law. With respect to transfers to countries not providing an adequate level of data protection, Netafim may base the transfer on appropriate safeguards, such as the EU standard contractual clauses adopted by the European Commission or other approved data transfer or certification mechanisms together with binding and enforceable commitments of the recipient. In each instance, Netafim will review the transfer and ensure that any additional technical and organizational measures are put in place to ensure that an adequate level of protection is provided. You are entitled to receive a copy of any documentation showing the suitable safeguards that have been taken by making a request using the contact details provided in Section 12 below.
